In order to provide tutoring services, we may collect personal information such as the Client’s name, contact details, payment information, and other relevant data necessary for service delivery. We may also collect information about the Client’s educational progress, learning preferences, and any communication related to our services.

1.2. Use of Information:

The information collected is used solely for the purpose of delivering and improving our tutoring services, including:
i. Managing tutoring sessions and scheduling;
ii. Processing payments and providing receipts;
iii. Communicating important information about your account and services;
iv. Analyzing performance to provide personalized tutoring support.
We will not use your information for any purpose other than those stated unless we have obtained explicit consent from you.
i. Marketing: With consent, we may send promotional materials related to new services or offers. Clients can opt-out at any time.
ii. Legal and Regulatory Compliance: To comply with applicable laws and regulations, and protect our legal rights.

1.3. Data Sharing and Disclosure:

Pediaverse Innovation Limited will not share, sell, or rent your personal data to third parties except in the following circumstances:
i. With trusted partners and service providers who assist in operating our services (e.g., payment processors), provided they are bound by confidentiality agreements;
ii. As required by law, to comply with legal obligations, or to protect the safety, rights, and property of Pediaverse Innovation Limited, its Clients, or others.

1.4. Data Security:

We take the protection of your personal data seriously and implement a variety of security measures, including encryption and access controls, to safeguard the information we collect.

1.5. Retention of Data:

We will retain your personal information for as long as necessary to provide services to you, to comply with legal obligations, resolve disputes, and enforce our agreements. Once the information is no longer required, we will securely delete or anonymize it.

1.6. Client Rights:

You have the right to:
i. Access the personal information we hold about you;
ii. Request corrections or updates to your data;

1.7. Changes to the Privacy Policy:

Pediaverse Innovation Limited reserves the right to modify this Privacy and Data Protection Policy at any time. We will notify Clients of any significant changes via email or through a prominent notice on our website. By continuing to use our services after such changes, you consent to the revised policy.

2. LIABILITY

2.1. Limitation of Liability:

Pediaverse Innovation Limited provides tutoring services with the utmost care and professionalism; however, we do not guarantee specific results or outcomes, such as improved grades, performance in exams, or other academic achievements. The Client acknowledges that academic success depends on several factors, including the student's efforts, commitment, and external circumstances beyond our control. To the fullest extent permitted by law, Pediaverse Innovation Limited’s total liability in connection with the services provided under this agreement shall be limited to the total amount paid by the Client for the tutoring sessions in question. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, educational opportunities, or data.

2.2. Responsibility of the Client:

The Client agrees to provide accurate information regarding the student’s learning needs, any specific concerns, and other relevant details that may assist in the provision of effective tutoring services. The Client also agrees to ensure that the student is adequately prepared for each tutoring session and to notify the Tutor or Pediaverse Innovation Limited promptly if any issues arise.

2.3. Force Majeure:

Pediaverse Innovation Limited will not be held liable for any failure or delay in the performance of its obligations under this agreement due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, government restrictions, technical failures, or any other events of force majeure.

2.4. Indemnity:

The Client agrees to indemnify, defend, and hold harmless Pediaverse Innovation Limited, its officers, employees, agents, and representatives from and against any claims, damages, liabilities, costs, or expenses arising from the Client’s breach of this agreement, misuse of the tutoring services, or violation of any applicable laws.

3. INTELLECTUAL PROPERTY POLICY

3.1. Ownership of Educational Materials and Content:

All educational materials, resources, content, or proprietary methodologies created by Pediaverse Innovation Limited (including tutors) for the purpose of delivering tutoring services are the exclusive property of Pediaverse Innovation Limited. This includes but is not limited to lesson plans, teaching aids, worksheets, videos, presentations, and any other intellectual work developed in the course of providing services to Clients.

3.2. Usage Rights:

Clients and Students are granted a limited, non-transferable, and non-exclusive right to use the educational materials provided during tutoring sessions solely for personal, educational purposes. These materials may not be reproduced, distributed, or shared outside of the tutoring sessions without prior written consent from Pediaverse Innovation Limited.

3.3. Copyright Protection:

All materials provided by Pediaverse Innovation Limited are protected by copyright laws. Unauthorized use, reproduction, or distribution of these materials, in whole or in part, is strictly prohibited and may result in legal action.

3.4. Tutor Contributions:

If a tutor contributes any original content, materials, or methods in connection with tutoring services, the intellectual property rights to such contributions will belong to Pediaverse Innovation Limited, unless otherwise agreed upon in writing. Tutors agree to assign and transfer any rights to such content to Pediaverse Innovation Limited as part of their engagement.

3.5. Client Materials:

While the Client retains ownership of any personal educational materials or assignments submitted by the student (e.g., homework, personal notes), Pediaverse Innovation Limited reserves the right to use anonymized and aggregated data (such as academic progress) for improving services, research, or case studies, unless the Client explicitly requests otherwise.

3.6. Trademarks and Branding:

Pediaverse Innovation Limited owns all trademarks, logos, and branding associated with our services. Clients and Tutors are prohibited from using our trademarks or branding without prior written consent.

3.7. Infringement Notification:

If any Client, Tutor, or third party believes that their intellectual property rights have been infringed upon by the content provided by Pediaverse Innovation Limited, they should notify us immediately. We will investigate the issue and, where applicable, take appropriate action to address any infringement.

3.8. Modification of Policy:

Pediaverse Innovation Limited reserves the right to update or modify this Intellectual Property Policy at any time. Clients and Tutors will be notified of any significant changes, and continued use of our services will be deemed acceptance of the updated policy.
